Year-end gifts for a medical practice: thanking your team

What the law regulates, and what it does not

Healthcare professionals are well aware of the anti-gift regulations, which in principle prohibit health sector companies (pharmaceutical laboratories, medical device manufacturers) from offering benefits to healthcare professionals, except under specific exemptions.

These regulations apply to gifts received from the industry. They do not apply to gifts that a physician or practice offers to their own employees or associates. Giving a year-end gift set to your team falls under the general rules applicable to employers.

Social security contribution rules

For practice employees, gifts offered by the employer for Christmas can be exempt from social security contributions within the same limits as works council (CSE) gifts: 5% of the monthly Social Security ceiling per employee per event. Your accountant can confirm how this applies to your structure.

Choosing the right gift set

• for the team: a two-bottle gift box, a white and a red or a Champagne, appealing to all palates;
• for partners and regular substitutes: a rarer bottle, a cellaring wine;
• for team members who do not drink alcohol: a gourmet food alternative of equal value.
